Terms & Conditions

Effective Date: August 20, 2026 These Terms & Conditions govern services provided by San Diego Pooper Scoopers LLC (“San Diego Pooper Scoopers,” “Company,” “we,” “us,” or “our”). By purchasing, scheduling, or receiving service, you (“Customer,” “you,” or “your”) agree to these Terms & Conditions.

1. Services

San Diego Pooper Scoopers provides recurring residential and approved commercial dog-waste removal services within our current service area. Available services may include: Signature Weekly Waste Removal Elite Twice Weekly Waste Removal Estate Premier Service Custom Service The service frequency, price, property requirements, and other details for your selected plan are those displayed at checkout or otherwise agreed to in writing. Service plans are subject to address, property, safety, and route availability. Submitting an order does not guarantee that an address can be added to our route. We will contact you if we cannot service your location or if a different plan or price is required. We reserve the right to decline or discontinue service when an address is outside our service area, cannot be efficiently incorporated into our route, presents unsafe or inaccessible conditions, or is otherwise unsuitable for service. We will never refuse service for an unlawful discriminatory reason.

2. Customer Information

You agree to provide complete and accurate information, including: Your name and contact information The correct service address The number of dogs on the property Gate codes and access instructions The approximate time since pet waste was last removed Whether dogs may be outside during service Any property, pet, or safety information that could affect service You must notify us if this information changes. A change in the number of dogs, property size, service area, yard condition, or requested frequency may require a different service plan or price. Any change will be communicated before additional charges are applied.

3. Service Schedule

Service is performed according to the frequency included with your selected plan. Weekly service generally includes one scheduled visit per week. Twice-weekly service generally includes two scheduled visits per week. The monthly billing date is not necessarily a service date. Recurring billing pays for your ongoing place on our service route and the service frequency included with your plan. Service days may be assigned based on route efficiency and may change as routes develop. Arrival times are not guaranteed. You are not required to be home while service is performed, provided that safe and unobstructed outdoor access is available. We may adjust service dates because of weather, holidays, illness, emergencies, vehicle or equipment problems, unsafe conditions, or other circumstances beyond our reasonable control. When reasonably possible, we will reschedule an affected visit or adjust the route accordingly.

4. Property Access

You must provide safe and direct outdoor access to all areas requiring service. Our technicians do not enter homes or walk through residences to reach backyards. Gates must be unlocked or accessible using the instructions provided before the technician arrives. Gate codes and access instructions must remain current. If we cannot access the service area because of a locked gate, incorrect access information, blocked entrance, unsafe animal, construction, or another condition within the Customer’s control, the visit may be considered attempted and completed for billing purposes. Refunds or credits are not guaranteed for inaccessible properties. Our technicians will make a reasonable effort to close gates as they were found. Customers remain responsible for checking gates and securing pets after service. Nothing in these Terms limits responsibility for damage caused by our proven negligence.

5. Dogs and Animal Safety

Customers must disclose whether dogs are expected to remain outside during service and whether any dog has aggressive, territorial, unpredictable, or escape-prone behavior. Friendly dogs may remain outside only when the technician determines that it is safe to perform the service. Dogs that are aggressive, threatening, highly territorial, or likely to interfere with service must be secured indoors or in a separate enclosed area before arrival. We may refuse to enter or immediately leave a property if a technician reasonably believes that an animal or other condition presents a safety risk. A visit missed because an unsafe animal was not secured may be treated as an attempted visit and may not qualify for a refund or credit.

6. Yard Conditions and Scope of Cleanup

Standard service includes locating, collecting, and removing reasonably visible and accessible dog waste from the approved service area. Customers are responsible for keeping the service area reasonably maintained and accessible. Tall grass, heavy leaves, standing water, mud, landscaping materials, debris, excessive clutter, poor lighting, steep terrain, or other obstructions may prevent complete removal. We are not responsible for waste that is concealed, buried, frozen, inaccessible, or not reasonably visible during the scheduled visit. Service does not include the removal of human waste, hazardous substances, medical waste, chemicals, dead animals, or waste from animals not disclosed during enrollment unless separately agreed to in writing.

7. Initial or Excessive Accumulation

The first visit may require additional time when pet waste has accumulated for an extended period or when the property’s condition is substantially different from the information provided during enrollment. If the property requires work beyond the reasonable scope of the selected recurring plan, we may: Provide a separate initial-cleanup quote; Recommend a different service plan; Limit the first visit to a reasonable amount of work; or Decline service. No additional fee will be charged without notice and your authorization.

8. Waste Disposal

Collected waste will be sealed and either placed in the Customer’s designated outdoor trash receptacle or removed from the property, depending on the service arrangement selected or communicated to the Customer. The Customer is responsible for ensuring that any designated trash receptacle is accessible on the service day.

9. Recurring Billing and Automatic Renewal

Subscription services are billed automatically at the price and frequency displayed during checkout. Unless otherwise stated, subscriptions continue on a month-to-month basis and automatically renew until canceled. By purchasing a subscription, you authorize San Diego Pooper Scoopers and its payment processor to charge your saved payment method for: The initial subscription payment; Each recurring monthly payment; Applicable taxes; and Any additional charge that you separately approve. Your subscription price remains the same unless we notify you of a price change. We will provide any notice, cancellation instructions, and request for consent required by applicable law before a price change takes effect. If a payment is declined, reversed, disputed, or otherwise unsuccessful, we may suspend service until the account is brought current.

10. Promotions and Discount Codes

Promotions and discount codes are subject to the terms displayed with the offer. Unless expressly stated otherwise, a new-customer or first-payment discount applies only to the first subscription payment. Future recurring payments will be charged at the full regular subscription price. Promotions: Have no cash value; Cannot be applied retroactively; May not be combined unless expressly permitted; May be limited to one use per customer, household, service address, email address, payment method, or account; and May be modified or discontinued before use. Creating another account or using different contact information to obtain a new-customer promotion more than once is prohibited. We may cancel an improperly obtained discount or subscription.

11. Cancellation

You may cancel your subscription at any time. Customers who enrolled online may cancel online through their customer account or the subscription-management option provided with their order. Cancellation will not require an in-person visit or an unnecessary delay. If you experience difficulty canceling online, contact us through the Contact page on our website, and we will assist with cancellation. Unless otherwise required by law or expressly agreed to in writing, cancellation takes effect at the end of the current paid billing period. No additional recurring payment will be charged after cancellation becomes effective. Canceling a subscription does not automatically refund a payment already processed.

12. Refunds and Credits

Subscription payments are generally nonrefundable once the applicable billing period has begun. We do not ordinarily provide prorated refunds or credits for: Partial billing periods; Customer-requested skipped visits; Inaccessible properties; Unsecured or unsafe dogs; Waste hidden by excessive vegetation, leaves, debris, or other obstructions; or Conditions outside our reasonable control. If we are unable to perform a scheduled service and cannot reasonably reschedule it, we may issue an appropriate credit, refund, or other resolution at our discretion and as required by law. Refunding an individual payment does not necessarily cancel the underlying subscription. The subscription must also be canceled to prevent future recurring charges.

13. Skipped Visits and Customer Absences

Customers should contact us as soon as possible when they need to skip service or know that the property will be inaccessible. A temporary pause or skipped visit does not automatically cancel the subscription or recurring billing. Any pause, credit, or schedule adjustment must be confirmed by us. If service is skipped because of vacation, landscaping, construction, a locked gate, an unsecured animal, or another Customer-controlled condition, the regular subscription charge may still apply because route time was reserved.

14. Weather, Holidays, and Unsafe Conditions

Service may be delayed, shortened, rescheduled, or suspended because of: Heavy rain, flooding, lightning, extreme heat, wildfire conditions, or other severe weather; Mud or unsafe ground conditions; Government restrictions or emergencies; Holiday route changes; Unsafe animals or individuals; Hazardous materials; Construction or unstable structures; or Any condition that could reasonably endanger a technician. We will use reasonable efforts to communicate significant changes, but the safety of our technicians and customers takes priority.

15. Property Damage and Existing Conditions

Customers should notify us of fragile landscaping, damaged gates, broken latches, irrigation equipment, exposed wiring, holes, unstable surfaces, or other property conditions that may not be readily visible. We are not responsible for ordinary wear, preexisting damage, concealed hazards, defective gates or latches, irrigation components hidden below vegetation, or damage not caused by our negligence. Any claim concerning alleged property damage must be reported promptly and should include photographs and relevant details so that we can investigate.

16. Sanitation and Disease Prevention

We use reasonable sanitation practices intended to reduce cross-contamination between properties. However, no outdoor pet-waste service can guarantee the complete elimination of bacteria, parasites, viruses, insects, odors, or disease. Customers remain responsible for veterinary care, pest control, lawn maintenance, and maintaining sanitary conditions between scheduled visits.

17. Communications

By providing your telephone number and email address, you consent to receive service-related communications concerning: Account and subscription status; Billing and payment issues; Scheduling and route changes; Access problems; Safety concerns; Cancellations; and Other matters relating to your service. Consent to service-related communications does not constitute consent to receive marketing messages where separate consent is legally required.

18. Suspension or Termination by the Company

We may suspend or terminate service for reasons including: Nonpayment; Repeated payment failures; Unsafe animals or property conditions; Harassment, threats, or abusive conduct; Repeated access problems; Materially inaccurate customer information; Misuse of promotions; Service addresses outside our active route; Requests outside the scope of the purchased plan; or Any material violation of these Terms. When appropriate, we will provide notice of termination and stop future recurring charges. Any refund or credit will be determined based on services already provided, amounts paid, applicable law, and the circumstances of termination.

19. Limitation of Liability

To the fullest extent permitted by law, San Diego Pooper Scoopers will not be liable for indirect, incidental, special, consequential, or punitive damages arising from the service. Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, including liability resulting from proven gross negligence, willful misconduct, or other responsibility imposed by applicable law.

20. Privacy

Personal information is collected, used, and protected according to our Privacy Policy. Our website, payment processor, and commerce platform may also collect and process information according to their respective privacy practices. Do not submit unnecessary sensitive information in gate instructions or other form fields.

21. Changes to These Terms

We may update these Terms & Conditions to reflect changes to our services, operations, prices, technology, or legal requirements. Updated Terms will be posted on our website with a revised effective date. When legally required, we will provide advance notice or obtain consent before applying a material change to an existing subscription.

22. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any dispute that is not resolved informally will be handled by a court with proper jurisdiction in San Diego County, California, unless applicable law requires otherwise.

23. Severability

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.

24. Entire Agreement

These Terms, the Privacy Policy, the service description displayed at checkout, and any written service-specific agreement between the Customer and San Diego Pooper Scoopers constitute the entire agreement concerning the purchased service. If a service-specific written agreement expressly conflicts with these Terms, the service-specific agreement controls for that particular issue.
